1. Booking & Acceptance. Your booking is confirmed only when this Agreement is signed and the required payment is received. A typed name is a legally binding electronic signature. Making any payment also confirms your acceptance of these terms.
2. Deposit. A non-refundable deposit of 50% of the total contract amount reserves the event date, time slot, and artist team. The deposit covers turning away other bookings, event preparation, and ordering materials.
3. Balance & Card Authorization. The remaining balance is due fourteen (14) calendar days before the event date. By booking, Client authorizes Crosby Creations LLC to automatically charge the card used at booking for the balance on that date, and for any event-day overtime or add-ons Client requests. If the charge fails, Client has 48 hours to pay by another accepted method; after that, services may be cancelled with no refund.
4. Full Payment Required. Full payment is due at booking for (a) events of 50 guests or fewer, (b) any event booked fourteen (14) days or less before the event date, and (c) airbrush tattoo bookings. Full payments are subject to the same cancellation terms.
5. Pricing, Tax & Travel. Quotes are valid for 14 days; prices are locked once payment is received. DC sales tax (7%) applies. Travel beyond 20 miles from Hyattsville, MD is billed at $1.50 per mile round-trip, per vehicle; drive time over 1 hour one-way is billed at $50 per hour per artist; evening events more than 100 miles away add $200 per artist for lodging. Parking, tolls, and venue load-in fees are Client's responsibility. Matinee (10%) and Sunday (6%) discounts are capped at 15% combined. Accepted payment methods: Visa, Mastercard, Discover, American Express, bank transfer, and check payable to Crosby Creations LLC.
6. Package Quantities. Each package includes a set number of items. Items unused because guests did not attend or declined are not refunded or credited. Unpainted blank items remain the property of Airbrush Bar. Additional items requested on site are billed at the package's per-item rate.
7. Service Window & Overtime. Service runs for the booked time slot (Matinee 12β4pm or Evening 7β11pm) or the hours stated on the invoice. Delays caused by Client, the venue, or guests (late start, blocked access, workspace not ready) do not extend the service window or reduce the price. Overtime requested on site is billed at $250 per 30 minutes per artist and charged to the card on file.
8. Date Changes. Bookings are non-transferable to another person or event. Client may reschedule once, with at least 30 days' written notice and subject to availability, for a $150 rescheduling fee; payments transfer once to a new date within 6 months. A change requested with less than 30 days' notice is treated as a cancellation.
9. Client Cancellation. Cancellations must be sent in writing to order@airbrushbar.com. More than 14 days before the event: the 50% deposit is forfeited and any amount paid above the deposit is refunded within 7 business days. 14 days or less before the event: 100% of the contract amount is owed and non-refundable.
10. Cancellation by Airbrush Bar. If Airbrush Bar cannot perform for reasons within its control, it will first offer a qualified replacement artist. If none is available or Client declines, all payments, including the deposit, will be refunded within 7 business days. This refund is Airbrush Bar's sole liability.
11. Weather & Force Majeure. Outdoor events require a covered, dry, shaded workspace. Airbrush Bar may pause or relocate service for rain, high wind, or unsafe conditions; service time lost is not refunded. Neither party is liable for failure to perform due to circumstances beyond reasonable control, including severe weather, acts of God, government restrictions, transportation disruptions, or public-health emergencies; in that case, payments convert to a credit valid for 12 months.
12. Client to Provide. Good lighting; a 10Γ10 ft workspace; (3) 6-ft or 8-ft tables and (2) chairs; a standard power outlet within 25 ft; 6β10 ft of clearance from any food, buffet, or dessert area; and load-in access and parking. If these are not provided, service may be reduced with no refund.
13. Guest Conduct & Safety. Airbrush Bar uses water-based textile paints; light overspray may occur near the station. Client is responsible for guest conduct and for supervising minors. Airbrush Bar may refuse service to anyone who is unsafe, abusive, or intoxicated. Client is responsible for the replacement cost of equipment damaged by guests.
14. Designs & Logos. Client confirms it owns or has permission to use any logos, names, or artwork it provides, and agrees to indemnify Crosby Creations LLC for any claim arising from them. Airbrush Bar may decline designs that are offensive or that infringe a trademark or copyright.
15. Client-Supplied Items. Items must be clean, 100% cotton or canvas, and washed without fabric softener. They are accepted as-is; Airbrush Bar is not responsible for bleeding, shrinkage, or fabric damage, and its liability is limited to the replacement cost of the blank item.
16. Photos & Marketing. Airbrush Bar may photograph its work and station for portfolio and marketing use. Client may opt out in writing before the event. Identifiable minors will not be posted without a parent's consent.
17. Non-Solicitation. For 12 months after the event, Client (including any party planner) will not book any Airbrush Bar artist or assistant directly or through another company. Doing so incurs a placement fee of $2,500 per person.
18. Chargebacks. Client agrees to contact Airbrush Bar first to resolve any billing concern. Disputing a charge for services delivered or for non-refundable amounts is a breach of this Agreement; Client will owe the disputed amount plus a $100 dispute fee and collection costs. Airbrush Bar may submit this Agreement, payment records, and event photos as evidence.
19. Late Payment & Collections. Unpaid balances accrue a late fee of 1.5% per month (18% per year) until paid. Client is responsible for all reasonable costs of collection, including court costs, collection-agency fees, and reasonable attorney's fees. Crosby Creations LLC may pursue all remedies available under District of Columbia law, including a civil action or referral to a collection agency.
20. Legal Provisions.
Indemnification. Client agrees to indemnify, defend, and hold harmless Crosby Creations LLC, its owners, employees, contractors, and agents from any and all claims, damages, losses, liabilities, or expenses (including reasonable attorney's fees) arising out of or related to the event, the Client's guests, or the venue, except those caused by the gross negligence or willful misconduct of Crosby Creations LLC.
Limitation of Liability. The total liability of Crosby Creations LLC under this Agreement shall not exceed the total amount actually paid by Client under this Agreement. Under no circumstances shall Crosby Creations LLC be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of goodwill.
Independent Contractor. Crosby Creations LLC performs services as an independent contractor and not as an employee, agent, or partner of Client. Nothing in this Agreement creates an employment, joint-venture, or partnership relationship.
Governing Law & Venue. This Agreement is governed by the laws of the District of Columbia, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in the District of Columbia, and the parties consent to the jurisdiction of such courts.
Entire Agreement; Amendments; Severability. This Agreement is the entire agreement between the parties and supersedes all prior agreements, written or oral. Any modification must be in writing and signed by both parties. If any provision is found unenforceable, the remaining provisions remain in full force. Failure to enforce any provision is not a waiver of it.
Airbrush Bar requires 1 hour of setup time before service to organize the station and confirm Client preferences. Guests select one item to customize, one design from the display board, their name or nickname, and two colors in addition to black.
Wait 24 hours before the first wash. Set iron to medium heat, place a clean cloth over the design, and iron the design area for 5 seconds; allow to cool. Wash inside out in cold water with like colors. Air dry only.
